FEDERICO G. HINOJOSA, Justice.

The State appeals from the trial court's order granting a motion to suppress filed by appellee, Luis Exiga. See Tex. Code Crim. Proc. Ann. art. 44.01(a)(5) (Vernon Supp.2001). We affirm.
