¶ 1 Joanne Cherry requests special action relief from the trial court's denial of a motion for a bifurcated trial. Cherry argues that she is eligible for mandatory probation pursuant to Arizona Revised Statutes ("A.R.S.") section 13-901.01 (2001) unless a jury finds that her prior conviction for aggravated assault is a conviction for a "violent crime."
