PETERS, J.

Plaintiff, a New York corporation, commenced an action in September 1999 against Alan R. Kahn, Paul Vannuki, Vee Hockmeyer, James Lichtenberg and Paul Shaheen,1 as well as against Debra Berenda, a former employee, and others alleging a conspiracy to gain corporate control of plaintiff from its current governing group.2
