{¶ 1} During the early morning hours of August 4, 1988, Amanda Maher was found barely alive near the railroad tracks on the south side of Xenia. Maher died shortly thereafter while being flown to the hospital. Defendant-appellant, David L. Myers, who had been seen walking with Maher in the direction of the railroad tracks shortly before her body was discovered there, was indicted for the murder of Maher.
