¶ 1. ANDERSON, J.

This is a petition for leave to appeal.1 Prentiss M. McKinnie appeals a nonfinal order of the trial court denying his motion to bar his prosecution on double jeopardy grounds. Because we agree with the trial court that prosecution of McKinnie does not violate the constitutional protection against double jeopardy, we affirm.
