COCHRAN, J., delivered the opinion of the Court, joined by MEYERS, PRICE, WOMACK, JOHNSON, and HOLCOMB, JJ.

A jury convicted appellant of felony assault of an elderly person. It assessed a ten-year sentence, recommending that the judge place appellant on community supervision (probation) rather than send him to prison.
