HOWARD, J.
¶ 1 A jury found defendant/appellant Marcos Herrera guilty of driving under the influence of intoxicating liquor (DUI) and driving with a blood alcohol concentration (BAC) of.10 or above. The jury also acquitted Herrera of three counts of child abuse. The trial court suspended the imposition of sentence and placed Herrera on concurrent two-year terms of probation.
