Before the Court is a petition for post-conviction relief under 28 U.S.C. § 2255 filed by Jerry Resto-Díaz ("Resto"). The four-count second superseding indictment in his criminal case charged him and two other defendants with two counts of car-jacking, the second of which resulted in a death, in violation of 18 U.S.C. § 2119; two counts of using and carrying a firearm in relation to a crime of violence...
