Waldemar Burgos-Chaparro, the defendant-appellant in this case, was indicted along with 27 others on September 22, 1999, for his role in a major drug conspiracy involving cocaine and marijuana. Burgos was charged in one count with conspiracy to distribute both drugs and in a second count with conspiracy to import them.
