PATRICIA NUÑEZ, J.

The defendant is charged with sexual abuse in the third degree, in violation of Penal Law § 130.55, and two counts of forcible touching, in violation of Penal Law § 130.52 (1) and (2). The defendant moves for an order dismissing the charge of forcible touching on the grounds of facial insufficiency and for various other relief.
