OPINION AND ORDER

LAFFITTE, District Judge.

Plaintiff Carlos Torres Rosado ("Torres") brings this claim against Defendant the United States Department of Justice's Immigration and Naturalization Service ("INS") for employment discrimination. He alleges that the INS failed to consider Torres for a promotion due to his age in violation of the Age Discrimination in Employment Act.1
