Opinion by Justice FRANCIS.

A jury convicted Manuel Gallegos of murder and assessed punishment at fifty years in prison. In four issues, appellant complains (1) the evidence is legally and factually insufficient to support his conviction, (2) the trial court erred in failing to hold a hearing on his amended motion for new trial, and (3) the jury charge violated his due process rights.
