Tri-State Chemicals, Inc. (Tri-State) appeals from a final summary judgment denying it recovery against Western Organics, Inc. (Western). The latter had filed a traditional and "no evidence" motion for summary judgment. On appeal, the two issues raised by Tri-State involve whether the trial court erred in granting the motion.
