James Stelljes appeals the denial of his 24.035 motion for post-conviction relief without an evidentiary hearing. Mr. Stelljes pleaded guilty to second degree burglary, § 569.170, RSMo 2000,1 and the court sentenced him to three years imprisonment but suspended the sentence and placed him on probation for three years.
