This case arises out of David E. Harris's conviction after a jury trial of first degree sexual assault. We granted certiorari to review the court of appeals' unpublished decision in People v. Harris, No. 98 CA0335 (Colo.App.1999). The court of appeals reversed the conviction and ordered a new trial, holding that the trial court had impermissibly excluded evidence of the victim's prior sexual encounter...
