Appellant was charged by indictment with the offense of engaging in organized activity. Tex. Pen.Code Ann. § 71.02(a)(1) (Vernon Supp.2002). The indictment alleged a prior felony conviction for the purpose of enhancing the range of punishment. A jury convicted appellant of the charged offense, found the enhancement allegation true, and assessed punishment at seventy years confinement in the Texas Department...
