The instant controversy arose after the plaintiff, Konami (America) Inc., was sued by a business competitor for patent infringement. The plaintiff tendered defense of the case to its insurer, defendant Hartford Insurance Company of Illinois, under a provision of the insurance policy pertaining to "advertising injuries."
