The defendant Theodore N. Arita was charged by bill of information on September 1, 2000 with second degree battery, a violation of La. R.S. 14:34.1. The trial court denied the defendant's motion to quash on October 20, 2000. A bench trial took place on October 23 and 25, 2000, with the trial court taking the matter under advisement.
