This is a medical malpractice action brought by petitioner, Millicent Kassama, for herself and for her young daughter, Ibrion, against Aaron Magat, the obstetrician who treated her during her pregnancy.1 The action arises from the unfortunate fact that Ibrion was born with Down's Syndrome.2 Dr. Magat is not charged with having caused that disorder but rather with causing Ibrion to be born, with...
