Robert O. Livingston ("the husband") appeals the trial court's denial of his Rule 60(b), Ala. R. Civ. P., motion. Cheryl D. Livingston ("the wife") sued for a divorce on October 18, 2000. At the same time, the wife filed a motion for a restraining order and for temporary custody of the couple's minor son.
