Justice McDADE, delivered the opinion of the court:

Defendant, Melvin Henderson, was convicted of unlawful possession of a controlled substance on April 20, 2000, and was sentenced to five years' imprisonment. He filed a pro se post-conviction petition, which was summarily dismissed on January 11, 2001. Defendant appeals from his final judgment of conviction and the dismissal of his postconviction petition. We reverse and remand.
