OPINION

KEASLER, J., delivered the unanimous opinion of the Court.

Ricardo Ortiz was convicted of capital murder by committing murder in the course of retaliation or attempted retaliation.1 Pursuant to the jury's answers to the special issues set forth in Texas Code of Criminal Procedure, Articles 37.071 §§ 2(b) and 2(e),2 the trial judge sentenced appellant to death.
