The Texas Department of Transportation ("TxDOT") appeals from the trial court's denial of its plea to the jurisdiction. Tex. Civ. Prac. & Rem.Code Ann. § 51.104(a)(8) (Vernon 1997). We ordered the proceedings below stayed pending the outcome of the appeal. Tex.R.App. P. 29.3. We will affirm the trial court's order denying the plea to the jurisdiction.
