Early in the morning on New Year's Day 2001, Terrence J. Floyd was arrested for public drunkenness. At the time of his arrest, Floyd was searched and ammunition was found in his pocket. Based on this finding, Floyd was charged by indictment for possession of ammunition by a felon, in violation of 18 U.S.C. § 922(g)(1).
