Court of Appeals of Kentucky.

Discretionary Review Denied March 12, 2003.

Attorney(s) appearing for the Case

John R. Tarter, Henderson, KY, for appellant/cross-appellee.

Before GUDGEL, Chief Judge; BARBER, and BUCKINGHAM, Judges.
