STATEMENT OF THE CASE:

Ms. Katherine Marie Rutledge, (Rutledge) filed a "Petition for Damages Due to Negligence and Breach of Contract" against Hibernia National Bank (Hibernia) on June 25, 1999. Hibernia filed an exception of no cause of action on July 27, 1999. The trial court sustained Hibernia's exception on September 28, 1999 and dismissed Rutledge's suit with prejudice.
