COPE, J.

Carl E. Hurd appeals an order denying his motion for postconviction relief. We affirm in part and reverse in part.

Defendant-appellant Hurd was indicted for first degree murder, attempted first degree murder, and other offenses in Miami-Dade County circuit court case number 94-1017. The crime date was March 25, 1994.
