¶ 1 Following a bench trial, Appellant Ernest Gene Gunn was convicted of robbery and criminal conspiracy. He was sentenced to 25 to 50 years' imprisonment pursuant to the mandatory sentencing provisions of 42 Pa.C.S.A. § 9714(a)(2). On direct appeal, this Court affirmed and the Supreme Court denied allowance of appeal. Thereafter, Appellant filed a petition under the Post Conviction Relief Act, 42 Pa.C.S.A. §§ 9541-9546.
