This dispute concerns the employee spouse's public pension benefits which were being paid at the time of the parties' divorce. The non-employee spouse did not seek her community property share of the pension benefits, but instead obtained a judgment for permanent alimony. The amount of the alimony was less than her share of the pension benefits. Alimony was paid for seventeen years until the non-employee spouse filed a claim for partition of the pension...
