Tammie Semar and her husband, Kenneth, filed suit against The Kroger Company, its insurer, and several store employees, alleging that Mrs. Semar was injured when she fell on a bag of cookies that protruded from under a shelf into an aisle at a Kroger store in Lake Charles, Louisiana. Defendants filed a motion for summary judgment, arguing that Plaintiffs would be unable to meet their burden of proving that the store had actual or constructive notice...
