Jose Diaz was charged with kidnapping, three counts of aggravated assault, and possessing a firearm during the commission of a felony. He denied the charges and was tried before a jury. The jury found Diaz not guilty of kidnapping, but guilty of two counts of aggravated assault, one count of pointing a pistol at another as a lesser included offense of aggravated assault, and possessing a firearm during the commission of a felony.
