James Bush and Helen Bush sued Guaranty Pest Control, Inc. ("Guaranty"), in the Bibb Circuit Court. Their three-count complaint sought an award of damages on claims of negligence, breach of contract, and fraud. The case was tried before a jury between April 30, 2001, and May 2, 2001.
