MULLINS v. STATE

No. 4D01-3645.

806 So.2d 572 (2002)

Jeffrey MULLINS, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fourth District.

January 23, 2002.

Attorney(s) appearing for the Case

Jeffrey Mullins, Coleman, pro se.

No appearance required for appellee.

PER CURIAM.

We affirm the order summarily denying Appellant's motion for post-conviction relief, but not for the reasons given by the trial court's order of denial.

Appellant's motion for post-conviction relief was timely pursuant to Wood v. State, 750 So.2d 592 (Fla.1999), which applies to his case because he was in custody for purposes of the challenged conviction only during a six-month period of probation.
