Plaintiff Donald Tucker, a counselor for the Federal Bureau of Prisons ("BOP"), is also an ordained minister in the Church of the Nazarene. Tucker has been applying for a chaplaincy position with the BOP since 1996. The BOP refuses to hire him as a chaplain because it believes that he is not qualified for the position.
