RNR Investments Limited Partnership (RNR) appeals a summary judgment of foreclosure granted in favor of appellee, Peoples First Community Bank (the Bank). RNR argues that the trial court erred in granting summary judgment because disputed issues of material fact remained with respect to one of RNR's affirmative defenses. In that affirmative defense, RNR alleged that the Bank was negligent in lending $960,000 to RNR without consent of the limited partners...
