WEST v. WAL-MART STORES, INC.

No. 1D01-3049.

825 So.2d 507 (2002)

Renita WEST, Appellant, v. WAL-MART STORES, INC., Appellee.

District Court of Appeal of Florida, First District.

September 6, 2002.

Attorney(s) appearing for the Case

Stuart B. Yanofsky, P.A., Sunrise, for Appellant.

Jeffrey P. Gill of Vernis and Bowling, and Brent F. Bradley of Kinsey, Troxel, Johnson & Walborsky, P.A., Pensacola, for Appellee.

PER CURIAM.

Renita West appeals a final summary judgment in her slip-and-fall action which was granted in favor of Wal-Mart Stores, Inc., appellee. The record contains sufficient evidence of a dangerous condition to create genuine issues as to material facts regarding both whether a dangerous condition existed and whether Wal-Mart had constructive notice of the dangerous condition. See Reinhardt v. Winn-Dixie Stores, Inc., 791 So.2d 1226
