Plaintiff, Earl Gagnard, was involved in an automobile accident with defendant, Betty Baudin, the insured of co-defendant, Zurich American Insurance Company/Assurance Company of America. After Mr. Gagnard was discharged from treatment of accident injuries by Dr. Darron McCann, he slipped and fell at his home.
