In this non-jury trial, the judge in the Circuit Court for Montgomery County concluded that the testimony established that an accident occurred, but that the mere happening of an accident is not evidence of negligence. We agree with the general proposition recited by the court, but it is inapplicable to this case. This is not a "mere happening of an accident" scenario.<...
