This case reviews the burden of proof which the employee must present to overcome the legal presumption that an occupational disease was not contracted during her employment of less than one year and is therefore not covered by the Worker's Compensation Act. The worker's compensation judge ("WCJ") dismissed the plaintiff's claim for benefits for carpal tunnel syndrome following the presentation of her case at trial.
