PEOPLE v. EHLERT

No. 1-00-0273.

781 N.E.2d 500 (2002)

335 Ill. App.3d 467

269 Ill.Dec. 703

The PEOPLE of the State of Illinois, Plaintiff-Appellee, v. Elizabeth EHLERT, Defendant-Appellant.

Appellate Court of Illinois, First District, First Division.

November 18, 2002.

Attorney(s) appearing for the Case

Rita A. Fry, Public Defender of Cook County (Allan R. Sincox, of counsel), for Appellant.

Richard A. Devine, State's Attorney of Cook County (Renee Goldfarb and Peter Fischer, of counsel), for Appellee.

Justice McNULTY delivered the opinion of the court:

This case comes before us for a second time. In the first trial a jury found defendant, Elizabeth Ehlert, guilty of murdering her newborn child. We reversed the conviction because the prosecution presented irrelevant and highly prejudicial evidence that defendant had two abortions. People v. Ehlert, 274 Ill.App.3d 1026, 211 Ill.Dec. 243
