IN RE ESTATE OF HELM

No. 2D01-5471.

820 So.2d 449 (2002)

In re ESTATE OF Erma June HELM. Edward G. Helm, individually and as former guardian of Erma June Helm, deceased, Appellant, v. United Trust Company, as personal representative, Appellee.

District Court of Appeal of Florida, Second District.

July 10, 2002.

Attorney(s) appearing for the Case

John J. Waskom of Icard, Merrill, Cullis, Timm, Furen & Ginsburg, P.A. Sarasota, for Appellant.

Joseph W. Fleece, III, and Karen M. Kelly of Holland & Knight LLP, St. Petersburg, for Appellee.

GREEN, Judge.

Edward G. Helm argues on appeal that the probate court erred in requiring him to turn over to the appellee, United Trust Company, monies in three accounts. United Trust Company is the personal representative of Mr. Helm's deceased mother's estate. Because the probate court did not actually determine whether the accounts are part of the estate, we affirm. This decision shall have no effect as to ownership of the accounts.

Affirmed.
