Ronald Scott Hugger (respondent) was charged with various offenses including driving while intoxicated (DWI) after his vehicle was stopped by a police officer in February 2001. Following his pretrial motion to suppress evidence and dismiss all counts for lack of probable cause, the district court ruled that the state failed to show that the officer had a reasonable basis for stopping respondent's vehicle.
