Danny Ray Bragg sued Rent to Own, Inc. alleging malicious prosecution and intentional infliction of emotional distress. Both parties filed motions for summary judgment. The trial court granted partial summary judgment to Bragg, finding that Michael Smith, the employee who swore out an arrest warrant for Bragg, was "acting within the course and scope of his employment with Rent to Own, Inc. at the time he swore out the arrest warrant."
