The City of Crawfordsville ("City") appeals the trial court's grant of summary judgment to David Price, d/b/a David Price Excavating and David Price Excavating, Inc. ("DPE"), and the trial court's denial of the City's motion to correct error.1 The City raises three issues, which we consolidate and restate as whether the trial court erred by granting DPE's motion for summary judgment.
