1. This Federal Tort Claims Act case arises out of the death of three passengers, John H. Bauer, William H. Bauer III and Terry A. Spurgin, aboard a Beechcraft A-36 airplane bearing FAA registration No. N1812A, which crashed while en route from Louisville, Kentucky to Aurora, Illinois on March 20, 1998. The pilot was Daniel L.
