The Joseph Education Association/OEA/NEA (the association) filed an unfair labor practices complaint before the Employment Relations Board (ERB) against Joseph School District No. 6 (the district), asserting that the district had committed an unfair labor practice by refusing to arbitrate two grievances filed by a probationary teacher. The district argued that ERB lacked jurisdiction over the dispute and that the dispute was not subject to arbitration...
