Robert Smith challenges the trial court's order summarily denying his motion filed pursuant to Florida Rule of Criminal Procedure 3.850. Smith raises nine grounds for relief in his motion, one of which alleges error that is not conclusively refuted by the record before this court. We affirm without comment the trial court's denial of the other eight grounds, but we reverse and remand for further proceedings...
