The appellant, Daniel Deron Johnson, was convicted of manslaughter, a violation of § 13A-6-3, Ala.Code 1975. On September 7, 2000, the trial court sentenced him to 25 years' imprisonment. On October 10, 2000, Johnson's appellate counsel filed a motion for a judgment of acquittal or, in the alternative, a motion for a new trial.1 That same day, Johnson also filed a motion seeking recusal of the circuit court judge.
