This appeal arises out of the resignation of Allan L. Durand as trustee for the Jerome S. Fertel Trusts.1 Jerome S. Fertel appeals the entry of summary judgment against him by the trial court on 8 February 2002, in the amount of $230,000.00. For the following reasons, we affirm the judgment.
