Defendant waived indictment and consented to be prosecuted by a superior court information charging him with attempted criminal sale of a controlled substance in the third degree. Thereafter, the District Attorney made a plea offer which entailed defendant pleading guilty to that charge and receiving a sentence of 4½ to 9 years to be served by participating in a particular drug treatment program.
